Terms of Service | Kelty Designs

Welcome to Kelty Designs ("Kelty Designs," "we," "us," or "our"), a River Forest, Illinois company inspired by Kelty Lawn Care and operated by Three Green, LLC. By accessing or using keltydesigns.com, the AI Studio, the Material Partners directory, the designer marketplace, or any related service (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

1. Who we are

Kelty Designs is a curated marketplace connecting homeowners with independent landscape designers and architects. The site and billing are operated by Three Green, LLC, inspired by the work of Kelty Lawn Care — a River Forest, IL local installation company. Homeowners may also hire a Marketplace designer carrying the Installations badge, who designs and builds in their own region as an independent business. Kelty Designs will eventually move to a paid membership model for designers, billed by Three Green, LLC.

2. Eligibility & accounts

You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of information you submit and for safeguarding your account credentials. You are responsible for all activity that occurs under your account. The Kelty Designs site is fully administrator-operated: designer profiles, packages, and portfolios are added and maintained by Kelty Designs staff on behalf of approved designers.

3. AI Studio — AI-generated content

The AI Studio (including the image generator and the Plat → CAD tool) uses artificial intelligence to produce concept-only drafts — renderings, layouts, and visualizations — based on your inputs. AI Studio outputs are:

AI-generated drafts that are not 100% site-accurate and may contain errors, missing site conditions, code or zoning issues, unsafe geometry, incorrect dimensions or property lines, or plant/material choices unsuitable for your climate, soil, or property;
Not construction documents, engineering, surveys, permits, or professional design recommendations;
Not a guarantee of cost, feasibility, fit, lead time, plant survival, or final appearance.

Any AI Studio output — image or CAD draft — must be reviewed by a member of our Marketplace (or another qualified designer and/or installer) before you rely on it for purchasing, building, permitting, or any other decision.

Paid AI Studio credits are non-refundable once consumed by a successful generation. Failed generations are refunded automatically to your credit balance.

4. Material Partners directory

The Material Partners page is a directory of partner brands and suppliers (such as plant growers, paver manufacturers, natural-stone yards, and lighting companies) that our designers and clients may reference for materials and sourcing. Listings are informational only. Kelty Designs does not manufacture, stock, sell, or warrant any partner's products, and is not responsible for partner pricing, availability, lead times, warranties, or order fulfillment. Verify all product details directly with the manufacturer or supplier before purchasing.

5. Designer marketplace

Designers listed on Kelty Designs are independent contractors, not employees of Kelty Designs, Kelty Lawn Care, or Three Green, LLC. We curate the roster based on our own review of their work, but each designer is solely responsible for the scope, quality, timing, drawings, deliverables, and conduct of their engagement with you. Any contract for design services is between you and the designer. Designers carrying the Installations badge also offer build services as independent businesses within their stated service areas; installation contracts with those designers are solely between you and that designer's company.

6a. Designer profile & portfolio content rules

Designers may display their company name, email address, and website link on their profile card and public profile page. Portfolio images, captions, project descriptions, and attached PDFs should remain focused on the work itself, and Kelty Designs reserves the right to edit or remove content that is misleading, inappropriate, or otherwise inconsistent with marketplace standards.

7. Installation & outside installers

When installation is performed by Kelty Lawn Care within its River Forest, IL service area, it is governed by a separate written installation agreement between you and Kelty Lawn Care.

When installation is performed by any third-party or outside installer — including a Marketplace designer with the Installations badge, or any installer we help you source — that installer is an independent business, not an agent or partner of Kelty Designs. Kelty Designs is not accountable for the workmanship, conduct, timelines, warranties, code compliance, pricing, or final installed product of any outside installer. Your contract for installation is solely with the installer you hire.

8. Your content & license

You retain ownership of photos, plats, site information, preferences, and other materials you submit ("Your Content"). You grant Kelty Designs a worldwide, royalty-free license to host, store, reproduce, and process Your Content as needed to operate the Services, including generating AI outputs for you and improving the Services in aggregate, non-identifying form.

Promotional & marketing use. By submitting, uploading, or otherwise providing any company information, branding, logos, headshots, project photos, portfolio images, PDFs, package descriptions, or other content to keltydesigns.com (including through the designer application, designer profile, Material Partners directory, or any form on the site), you grant Kelty Designs and Three Green, LLC a perpetual, worldwide, royalty-free, sublicensable right to use, reproduce, display, distribute, adapt, and showcase that content as promotional, marketing, advertising, and editorial material — on keltydesigns.com, in social media, email campaigns, press, partner features, case studies, paid ads, and any other channel — for the overall benefit and growth of the Kelty Designs collective community. You represent that you have all rights necessary to grant this license.

9. Intellectual property

The Kelty Designs name, logo, site design, software, and curated content are owned by Three Green, LLC. AI Studio outputs generated for you may be used for your personal project; commercial resale or redistribution is not permitted without written permission.

11. Acceptable use

No unlawful, infringing, defamatory, or harassing content;
No scraping, reverse engineering, or interfering with the Services;
No attempts to bypass rate limits, paywalls, or security controls;
No use of the AI Studio to generate content that is deceptive, unsafe, or violates third-party rights.

12. Disclaimers

THE SERVICES, AI STUDIO OUTPUTS, AND MATERIAL PARTNER LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KELTY DESIGNS, KELTY LAWN CARE, AND THREE GREEN, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES, AI OUTPUTS, MATERIAL PARTNER LISTINGS, OR ANY WORK PERFORMED BY AN INDEPENDENT DESIGNER OR OUTSIDE INSTALLER. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO KELTY DESIGNS (THROUGH THREE GREEN, LLC) FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kelty Designs, Kelty Lawn Care, and Three Green, LLC from any claims, damages, or expenses arising from (a) Your Content, (b) your use of AI Studio outputs, (c) any work you contract directly with a designer or outside installer, or (d) your violation of these Terms or applicable law.

15. Third-party links & services

The Services may link to third-party sites, including Material Partner websites and designer company websites. We do not control and are not responsible for third-party content, products, or practices.

16. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance.

18. Governing law & venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles. Exclusive venue for any dispute lies in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction there.
