Terms of Service

Welcome to Kelty Designs ("Kelty Designs," "we," "us," or "our"), a River Forest, Illinois company operated by Kelty Lawn Care in partnership with Three Green, LLC (billing). By accessing or using keltydesigns.com, the AI Studio, the Materials Library, the designer marketplace, or any related service (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

1. Who we are

Kelty Designs is a curated marketplace connecting homeowners with independent landscape designers and architects, paired with optional installation services. Site and billing are operated by Three Green, LLC. Installation, when offered through us, is performed by Kelty Lawn Care or, outside our service area, by an independent local installer we may help you source.

2. Eligibility & accounts

You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of information you submit and for safeguarding your account credentials. You are responsible for all activity that occurs under your account.

3. AI Studio — AI-generated content

The AI Studio uses artificial intelligence to produce concept-only renderings, layouts, and visualizations based on your inputs. AI Studio outputs are:

• AI-generated and may contain errors, inaccuracies, missing site conditions, code or zoning issues, unsafe geometry, or plant/material choices unsuitable for your climate, soil, or property;
• Not construction documents, engineering, surveys, permits, or professional design recommendations;
• Not a guarantee of cost, feasibility, fit, lead time, plant survival, or final appearance.

You must have any AI Studio output reviewed by a qualified designer and/or installer before relying on it for purchasing, building, or any other decision.

4. Materials Library — AI-generated content

Product imagery, descriptions, specifications, pricing references, and related content in the Materials Library are AI-generated and provided for inspiration and general reference only. Information may be outdated, inaccurate, or differ from any actual third-party product. Outbound links may route through third-party search providers (e.g., DuckDuckGo) and we do not control the results. Verify availability, dimensions, finish, pricing, and suitability directly with the manufacturer or supplier before purchasing.

5. Designer marketplace

Designers listed on Kelty Designs are independent contractors, not employees of Kelty Designs, Kelty Lawn Care, or Three Green, LLC. We curate the roster based on our own review of their work, but each designer is solely responsible for the scope, quality, timing, drawings, deliverables, and conduct of their engagement with you. Any contract for design services is between you and the designer.

6. Lead routing & anti-circumvention

All leads, inquiries, quotes, bookings, and engagements generated through the Kelty Designs marketplace — including any introduction made between a homeowner and a listed designer via the Services — must be processed through the Kelty Designs system. This includes intake, scoping, quoting, contracting, and payment.

If a designer (company or individual) is found soliciting, accepting, or continuing work with a Kelty Designs-sourced lead outside of our system — directly, through a side channel, or via a related entity — it will result in immediate termination of their marketplace listing, forfeiture of any pending payouts tied to circumvented work, and may result in further legal action to recover platform fees and damages.

6a. Designer profile & portfolio content rules

To preserve the integrity of the marketplace and ensure all communication is routed through Kelty Designs, no company name, website link, phone number, or email address may appear:

• on a designer's profile card or public profile page;
• in any portfolio image, caption, project description, or attached document (including PDFs);
• in any watermark, logo, overlay, or metadata on uploaded media.

Submissions that include contact or branding information will be edited or removed prior to publication, and repeat violations may result in suspension or termination of the listing.

7. Installation & outside installers

When installation is performed by Kelty Lawn Care within our service area, it is governed by a separate written installation agreement between you and Kelty Lawn Care.

When installation is performed by any third-party or outside installer — including any installer we help you source — that installer is an independent business, not an agent or partner of Kelty Designs. Kelty Designs is not accountable for the workmanship, conduct, timelines, warranties, code compliance, pricing, or final installed product of any outside installer. Your contract for installation is solely with the installer you hire.

8. Quotes, pricing & billing

Quotes and AI-generated price ranges are estimates only and are not binding until confirmed in a signed agreement. Billing for Kelty Designs services is handled by Three Green, LLC. Taxes, fees, and third-party costs may apply. Refunds, if any, are described at the time of purchase or in your engagement agreement.

9. Your content & license

You retain ownership of photos, site information, preferences, and other materials you submit ("Your Content"). You grant Kelty Designs a worldwide, royalty-free license to host, store, reproduce, and process Your Content as needed to operate the Services, including generating AI outputs for you and improving the Services in aggregate, non-identifying form.

10. Intellectual property

The Kelty Designs name, logo, site design, software, and curated content are owned by Kelty Lawn Care and/or Three Green, LLC. AI Studio and Materials Library outputs generated for you may be used for your personal project; commercial resale or redistribution is not permitted without written permission.

11. Acceptable use

• No unlawful, infringing, defamatory, or harassing content;
• No scraping, reverse engineering, or interfering with the Services;
• No attempts to bypass rate limits, paywalls, or security controls;
• No use of AI Studio or Materials Library to generate content that is deceptive, unsafe, or violates third-party rights.

12. Disclaimers

THE SERVICES, AI STUDIO OUTPUTS, AND MATERIALS LIBRARY CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KELTY DESIGNS, KELTY LAWN CARE, AND THREE GREEN, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES, AI OUTPUTS, MATERIALS LIBRARY CONTENT, OR ANY WORK PERFORMED BY AN INDEPENDENT DESIGNER OR OUTSIDE INSTALLER. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO KELTY DESIGNS (THROUGH THREE GREEN, LLC) FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kelty Designs, Kelty Lawn Care, and Three Green, LLC from any claims, damages, or expenses arising from (a) Your Content, (b) your use of AI Studio or Materials Library outputs, (c) any work you contract directly with a designer or outside installer, or (d) your violation of these Terms or applicable law.

15. Third-party links & services

The Services may link to third-party sites (including search providers and manufacturer pages). We do not control and are not responsible for third-party content, products, or practices.

16. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance.

18. Governing law & venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles. Exclusive venue for any dispute lies in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction there.
